These Terms of Service (“Terms”) govern your access to and use of DesignZonal.com (the “Site”), the DesignZonal directory, digital services provided by DesignZonal, and other features, products, and services we make available (collectively, the “Services”).
By accessing or using the Site or Services, you agree to these Terms. If you do not agree to these Terms, please do not use the Site or Services.
DesignZonal helps businesses build and improve their online presence through professional digital services, while also making it easier to discover and compare web designers, developers, digital agencies, and other digital professionals.
DesignZonal may provide digital services directly to clients, including website design and development, website redesign, website maintenance and technical support, SEO and digital growth services, e-commerce services, AI and automation solutions, and related digital services.
DesignZonal also operates an online directory through which independent businesses and professionals may be listed or discovered.
You must be at least 18 years old and legally capable of entering into a binding agreement to use Services that require a contract, purchase, account, or business submission.
If you use DesignZonal on behalf of a company, organization, or other entity, you represent that you have authority to act on behalf of and, where applicable, bind that entity to these Terms.
Certain features of DesignZonal may allow or require you to create an account. If you create an account, you agree to:

We may restrict, suspend, or terminate an account when reasonably necessary to protect the Site, enforce these Terms, address unlawful or abusive activity, or protect DesignZonal or other users.
Businesses may engage DesignZonal directly for website, development, maintenance, SEO, e-commerce, automation, consulting, or other digital services.
The specific scope, price, deliverables, payment schedule, revision terms, responsibilities, and estimated timeline for a project may be described in a proposal, estimate, invoice, order, statement of work, email agreement, or other project-specific document.
If project-specific terms conflict with these general Terms regarding the specific project, the project-specific terms will control to the extent of that conflict.
Clients are responsible for providing information, materials, content, approvals, access credentials, feedback, and other items reasonably necessary to complete their projects.
Delays in providing required materials, feedback, access, or approvals may affect project schedules and delivery dates.
You represent that you have the necessary rights or permissions to provide any text, images, logos, trademarks, data, files, software, or other materials you provide to DesignZonal for use in your project.
Any project schedule or completion date is an estimate unless DesignZonal expressly agrees in writing that a specific deadline is guaranteed. Project timing may depend on project complexity, client responsiveness, requested revisions, third-party services, technical conditions, and other factors.
While DesignZonal aims to provide professional services designed around each project’s objectives, we do not guarantee any particular business, financial, search-ranking, traffic, conversion, revenue, sales, or other commercial result.
SEO, advertising, marketing, automation, and other digital strategies may depend on search engines, advertising platforms, algorithms, competitors, market conditions, third-party systems, and other factors outside DesignZonal’s control.
The number or extent of revisions included in a project may be established in the applicable proposal, estimate, statement of work, or other project-specific agreement.
Requests that materially change the original scope, features, functionality, design direction, integrations, content requirements, or deliverables may require additional fees or a revised project schedule.
We will attempt to communicate material scope changes before performing additional billable work.
Prices and payment requirements for DesignZonal’s paid Services will be communicated before purchase or through the applicable project agreement, proposal, invoice, checkout page, or order.
By purchasing a paid Service, you agree to pay the disclosed charges and authorize DesignZonal and its payment service providers to process the applicable payment using your selected payment method.
Depending on the project or Service, payment may be required upfront, through a deposit, in installments, according to project milestones, or on another disclosed schedule.
Refunds and cancellations are governed by our Refund & Cancellation Policy and any additional project-specific terms agreed to by the parties.
Digital projects may use or depend on third-party products and services, including hosting providers, domain registrars, plugins, themes, software, APIs, stock assets, payment processors, e-commerce platforms, analytics tools, advertising platforms, or other technology providers.
Unless otherwise agreed, third-party products and services are governed by their respective providers’ terms, policies, availability, and pricing.
DesignZonal is not responsible for outages, policy changes, pricing changes, discontinued features, security incidents, service interruptions, or other actions of independent third-party providers that are outside our reasonable control.
DesignZonal operates a directory designed to help users discover and research web designers, developers, digital agencies, and related professionals.
Directory information may come from business submissions, business owners, publicly available information, or other sources.
We aim to maintain useful directory information, but we do not guarantee that every listing is complete, current, accurate, available, endorsed, certified, or suitable for a particular project.
Users should independently evaluate a professional before hiring them, including reviewing their experience, portfolio, pricing, credentials, contracts, references, insurance, licensing where applicable, and other information relevant to the project.
Eligible web designers, developers, agencies, and other digital professionals may be able to submit, claim, create, or manage a business listing on DesignZonal.
If you submit or manage a listing, you agree that the information you provide will not knowingly be false, deceptive, infringing, unlawful, or materially misleading.
You are responsible for maintaining the accuracy of information you submit, including business details, service information, website links, images, descriptions, portfolios, and other content.
DesignZonal may edit, format, categorize, supplement, reject, suspend, merge, or remove listings when reasonably necessary for accuracy, consistency, quality, safety, legal compliance, or operation of the directory.
Submission or inclusion of a business does not guarantee any particular placement, ranking, visibility, traffic, inquiries, customers, or business results.
You retain ownership of content you own and submit to DesignZonal.
By submitting content for publication on the Site, you grant DesignZonal a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, adapt as reasonably necessary for presentation, and distribute that content in connection with operating, displaying, promoting, and improving DesignZonal and its Services.
This license does not transfer ownership of your content to DesignZonal.
You represent that you have the rights necessary to submit the content and grant the permissions described above.
Unless DesignZonal expressly states otherwise, professionals and companies appearing in the directory are independent businesses.
A directory listing does not by itself constitute an endorsement, recommendation, certification, employment relationship, partnership, joint venture, or agency relationship between DesignZonal and the listed professional.
If you choose to hire an independent professional discovered through the directory, the agreement for that professional’s services is between you and that professional unless DesignZonal expressly identifies itself as a party to the transaction.
DesignZonal is not responsible for the acts, omissions, pricing, contracts, communications, performance, workmanship, representations, or disputes of independent directory professionals.
DesignZonal may offer optional paid directory features, advertising, enhanced profiles, featured placement, promotional services, or other paid products now or in the future.
When such a product is offered, its price, billing structure, features, duration, renewal terms, and any applicable cancellation conditions will be disclosed before purchase.
Purchasing a promotional or directory feature does not guarantee traffic, leads, customers, search-engine rankings, sales, or other business results.
When you submit a contact form, project inquiry, directory inquiry, or other request through DesignZonal, you authorize us to use the information you provide to respond to your request and provide the requested Services.
Communications involving personal information are also subject to our Privacy Policy.
You agree not to use DesignZonal to:
The DesignZonal name, branding, logos, Site design, original Site content, graphics, software, and other materials created or owned by DesignZonal are protected by applicable intellectual property laws.
Except as permitted by law or expressly authorized by DesignZonal, you may not copy, reproduce, distribute, modify, sell, license, or commercially exploit DesignZonal-owned materials without permission.
Third-party names, logos, trademarks, images, and content remain the property of their respective owners.
Ownership and usage rights for custom work created by DesignZonal for a client may be addressed in the applicable project proposal, agreement, invoice, or statement of work.
Unless otherwise agreed in writing, third-party software, fonts, plugins, themes, stock assets, libraries, platforms, and other licensed materials remain subject to their original licenses and are not transferred beyond the rights permitted by those licenses.
Client-provided trademarks, logos, content, images, and other materials remain the property of the client or their respective owners.
Your use of DesignZonal is also subject to our Privacy Policy, which describes how we collect, use, and handle personal information.
Please review the Privacy Policy together with these Terms.
We may modify, improve, replace, suspend, or discontinue portions of the Site or Services from time to time.
We do not guarantee that the Site or every feature will always be available, uninterrupted, secure, or error-free.
Maintenance, technical problems, security issues, third-party services, infrastructure changes, or circumstances outside our control may occasionally affect availability.
To the maximum extent permitted by applicable law, the Site, directory, and general platform features are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
DesignZonal does not warrant that directory information will always be complete or error-free, that the Site will operate without interruption, or that use of the directory or other Services will produce a particular business result.
Nothing in this section eliminates any warranty or obligation that cannot lawfully be excluded or any specific commitment expressly made by DesignZonal in a written project agreement.
To the maximum extent permitted by applicable law, DesignZonal and its owners, affiliates, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site or Services.
This may include, where legally permitted, loss of profits, revenue, business opportunities, goodwill, or data.
DesignZonal is not responsible for losses arising from transactions, agreements, communications, or disputes between users and independent professionals discovered through the directory.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless DesignZonal and its owners, affiliates, employees, contractors, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Services, your content, your violation of these Terms, or your violation of another person’s rights.
We may suspend or terminate access to certain Services or accounts if we reasonably believe a user has violated these Terms, engaged in fraudulent or unlawful conduct, created a security risk, abused the platform, or materially interfered with the rights of DesignZonal or others.
You may stop using DesignZonal at any time. Ending your use of the Site does not eliminate payment obligations or other responsibilities that arose before termination.
We may update these Terms from time to time to reflect changes to our Services, business practices, technology, or legal requirements.
The revised Terms will be posted on this page with an updated “Last Updated” date.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
Subject to any rights or remedies that cannot lawfully be waived, disputes arising out of or relating to these Terms or the Services will be handled in the applicable state or federal courts located in Passaic County, New Jersey.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.
DesignZonal’s failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
These Terms, together with the Privacy Policy, Refund & Cancellation Policy, and any applicable project-specific agreement, proposal, order, or statement of work, constitute the applicable agreement between you and DesignZonal concerning the Services they govern.
